Newly Amended Article 185-3 of Criminal Code Tightens Ban on Drunk Driving

Drivers must pay attention to this message! The President promulgated the newly amended article 185-3 of Criminal Code on June 11 and it has become effective since June 13, 2013. Taichung City Government Police Department has also started to implement the new law at 0:00 on June 13, 2013.It is urged that drivers do not drink and drive!

Taichung City Government Police Department will strengthen enforcement of drunk driving-related ban. If a driver’s breath alcohol content is 0.25 milligrams per liter or more, or blood alcohol concentration is of 0.05% or more, he/she will be sent to the Prosecutors Office in accordance with laws. Moreover, according to the newly amended article 114-2 of Act Governing the Punishment of Violation of Road Traffic Regulations, a person should not drive if he/she has taken alcohol or other similar substances and his/her breath alcohol content is 0.15 milligrams per liter or his/her blood alcohol concentration is 0.03%. To implement the newly amended laws and regulations, the police will take the following law enforcement actions:
(1) Advice: A driver whose breath alcohol content is 0.15, 0.16, or 0.17milligrams per liter, who has not caused any accident, and who can drive safely will be advised instead of being punished.
(2) Accusation: A driver whose breath alcohol content is 0.18 milligrams per liter or more, who has not caused any accident, and who can drive safely will be given a ticket on the spot and his/her vehicle should be relocated and kept in custody.
(3) A driver whose breath alcohol content is of 0.25 milligrams per liter or more or whose blood alcohol concentration is of 0.05% or more will be sent to the Prosecutors Office according to laws and regulations.

Commander Wu of Traffic Police Corps of Taichung City Government Police Department stressed that Taichung City Government Police Department vows to enforce the newly amended provisions by way of care, advocacy, advice, accusation, and punishment. “We are determined to clear away drunk driving cases to protect lives and property of our citizens. We hope Taichung City will become a model city without drunk driving,” said Commander Wu.
