(Taichung) Local Tax Bureau, Taichung City Government expressed that the Enforcement Rules of The Taxpayer Rights Protection Act (referred as Tax Payer Protection Act” in the following) will be enforced on December 28, 2017 to actualize the justice of tax levying and achieve the due process of law. All the tax collection institutions in different regions will establish the positions of tax payer rights protection officer (referred as tax paying protection officers in the following) to help tax payers in the communication, negotiation, and accept appeal and petition and provide necessary administrative remedies consultancies, and more. It will be helpful in protecting the rights of tax payers paying tax according to the laws and regulations.

The bureau pointed out that to consolidate the right to life, the right to work, property right, and other basic rights prescribe in the constitution, assure the rights of tax payers, and implement the due process of law. The Tax Payer Protection Act was stipulated and announced on December 28, 2016, and will be enforced one year after its announcement. After the enforcement of Tax Payer Protection Act, if tax payers have any controversy regarding the investigation process and stages of administrative remedies of tax collection institutions, they can request the Tax Paying Protection Officer to apply for communication and negotiation. If tax payers think the tax collection institutions upset their rights because of administrative loss and improper investigation, they can also appeal and petition at the Tax Paying Protection Officers. In addition, when tax payers intend to apply for remedies, the Tax Paying Protection Officers will also provide consultancies in the aspects of law, information on related cases, and related procedures to guarantee more protection to tax payers’ rights. And the establishment of Tax Paying Protection Officers aims to provide communication and negotiation between tax payers and tax collection institutions to solve controversies and promote harmony between both parties, creating win-win situations.
