When handling traffic accidents, the police are required to draw a scene sketch and prepare investigation records (statements) in accordance with the Directions Governing Road Traffic Accidents. These sketches and records must be signed by all parties involved in the accident. If there are doubts about the sketch or the investigation records, you can request the police for an explanation before signing. If omissions or errors are found, corrections can be requested. It is important to maintain a respectful tone and attitude and avoid disputes or conflicts with the investigating officers.
According to Article 100-3 of the Code of Criminal Procedure, the interrogation of criminal suspects shall not proceed at night unless the parties involved consent or under special circumstances (e.g., emergencies). Additionally, under Article 95 of the same law, the accused has the right to remain silent and no statements should be made against their own will.
If unwilling to participate in creating investigation records (statements) due to illness or other reasons, you can request to do so on another day. However, it is strongly recommended that, unless there are special circumstances, individuals cooperate with the police to gather evidence promptly to clarify the facts of the accident.
